Former FPÖ politician Hans-Jörg Genevein and liberal general secretary Christian Hafeneker were fined at the Burgersdorf district court (St. Paulden district) on Tuesday in a trial regarding fake Covid test certificates.

Jenewein will pay 2,000 euros, Hafenecker 5,100 euros. Three co-defendants, including Hafeneker’s wife, were acquitted. Judgments are not legally binding.

Jenewein must pay 100 daily fines of 20 euros each for data falsification, Hafenecker, as the intended perpetrator, 30 daily fines of 170 euros each. Some charges were acquitted. The judge said he had “not the slightest doubt” that Hafeneker instructed a parliamentary staffer to order fake test certificates from Genevein. The other accused were acquitted as they could not prove that they were responsible for the crime.

Genevein pleaded guilty to 20 charges

According to her defense attorney Christoph Rother, Genevein pleaded guilty to all 20 counts of perjury included in the indictment from May to August 2021. The ex-politician allegedly changed certificates on the computer, partly for himself and partly for others, including time and personal data. “The false antigen and PCR tests were within his competence,” the prosecutor said. There is no evidence that Genevieve was paid for this.

Fakes for hospital visits

Genevaine’s lawyer said his client had created fakes so he could always show a valid certificate when he visited his now-deceased wife in hospital – despite regular checks. He talked about this among his friends. The defense lawyer said the fakes were “misconceived” and Genevaine was very sorry for it. His client did not remember any specific orders. An investigation was launched after the ex-politician’s mobile phone was found.

Fake Corona Test Certificates for European Football Championship

Hafeneker, his wife and a family friend who works as a local councilor for the FPÖ were also charged. According to the Vienna public prosecutor’s office, they allegedly received fake corona test certificates from Genevein to watch the European Football Championship game in Budapest on June 23, 2021. Hafeneker reportedly secured tickets for the match on short notice. All three accused were tested to enter the stadium, but the results are still pending upon arrival, said a representative of the prosecution.

Hafeneker’s attorney appealed

The prosecutor’s office has not released a statement. Geneva’s defense attorney asked for time to think about it, and Hafeneker’s attorney appealed. Therefore the judgments are not legal.

According to her defense lawyer, Geneviene admitted to forging Covid test certificates for herself and others. According to the State Attorney’s Office, the four co-defendants are alleged to have acted as intended perpetrators and have denied the charges. The accused did not appear for the hearing on Tuesday. Defendants may be represented by defense attorneys at District Court hearings and do not have to appear in person.
