Manuel Delia has won the constitutional case against the Maltese Government, particularly Minister Owen Bonnici, who at the time was responsible for Justice and Culture. The case pertains to the removal of flowers and candles from the Monument of the Great Siege in Valletta which also serves as an unofficial memorial for the late Daphne Caruana Galizia.
In his decision, Judge Joseph Zammit McKeon said that the continuous cleaning of flowers and candles, infringed on the same Delia’s right to freedom of expression. Flowers and candles started making an appearance on the monument in October 2017, days after the assassination of Caruana Galizia. Workers from the cleansing department cleaned the monument on a regular basis, continually removing flowers, candles and even pictures of the journalist and messages left by activists.
The court heard that this was directly instructed by Minister Owen Bonnici himself, in view of the monument’s upcoming restoration in September 2018.
