Brothers Alfred and George Degiorgio, who are accused of activating the bomb that killed Daphne Caruana Galizia, have opened a judicial protest to challenge the presidential pardon granted to Melvin Theuma, the middleman in the murder case.
In the protest, submitted this morning by Attorney William Cuschieri, the defendants stressed that although the Attorney General had told the court that it is impossible for Melvin Theuma to testify in the compilation of evidence, because the facts occurred four months before issuing the indictment, the truth is that they have been aware of the information all along.
Cuschieri makes reference to the media reports saying that Vince Muscat (also charged with the murder of Daphne Caruana Galizia) was named in the media in April 2018. Muscat also requested a Presidential pardon which was not granted. Therefore, the Degiorgio brothers are demanding that the information passed by Theuma was not new, even more so as Yorgen Fenech was already suspected of being the mastermind of the killing and was under surveillance by the secret service.
The application further stresses that public information, including the photograph published by MaltaToday of Melvin Theuma with Keith Schembri, reveals the fact that the announcement was not based entirely on truth and that there was a conflict serious interest.
Consequently, the Degiorgio brothers are demanding that the presidential pardon is revoked.
